Habersham County, unlike all counties in northeast Georgia has a State Court to handle misdemeanor cases and a Superior Court to handle felony cases. The Habersham County State Court has jurisdiction over all misdemeanor cases, including misdemeanor domestic violence charges and all DUI cases to include DUI alcohol, DUI drugs, and DUI prescription medications. The Habersham County Superior Court has jurisdiction over all felony cases, which includes most drug arrests, felony DUI charges, and felony domestic violence cases. Misdemeanor and felony criminal charges could be a result of vehicle stops, searches of houses, or interactions with individuals in various situation.
Most DUIs in Habersham County are prosecuted in the Habersham County State Court, located in Clarksville, Georgia, and are prosecuted by the Solicitor General of Habersham County. The exception is for cases involving a felony DUI, because the charge is a fourth DUI in a 10 year period or because a person was seriously injured or killed in an accident. If there is a felony DUI charge, the case is prosecuted in the Habersham County Superior Court by the District Attorney.
Drug charges made by the Habersham County Sheriff's office, mostly as a result of vehicle searches following a traffic stop, are prosecuted by the District Attorney in the Superior Court of Habersham County, before one of the superior court judges. Habersham County shares a DA with Rabun and Stephens counties.
