Stephens County is home to the Stephens County State Court and the Stephens County Superior Court. Stephens County State Court is a part time court that has jurisdiction over all misdemeanor offenses. These misdemeanor offenses are prosecuted by the part time Solicitor General of Stephens County. Misdemeanor offenses include DUI alcohol, DUI drugs, DUI prescription medications, and some domestic violence charges. 

The Stephens County Superior Court has exclusive jurisdiction over felony criminal charges, and is the court that would hold jury trials for felony cases. Most drug cases are felony offenses and would be prosecuted in the Superior Court by the District Attorney of Stephens County. Additionally although most DUIs in Stephens County are prosecuted in the Stephens County State Court, located in Toccoa, Georgia, by the Solicitor General of Stephens County, felony DUIs,  because the charge is a fourth DUI in a 10 year period or because a person was seriously injured or killed in an accident is prosecuted in the Superior Court of Stephens County. If there is a felony DUI charge, the case is prosecuted in the Stephens County Superior Court by the District Attorney. Most drug charges made by the Stephens County Sheriff's office, mostly as a result of vehicle searches following a traffic stop, are prosecuted by the District Attorney in the Superior Court of Stephens County, before one of the superior court judges. Stephens County shares a DA with Rabun and Habersham counties.
